Houseparty Terms of Service

These Terms explain who may use Houseparty, what you can expect from the service, what we expect from you, and how safety, content, account actions, and disputes are handled.

Agreement and operator

These Terms of Service ("Terms") are a binding agreement between you and Nibble Audio, Inc. ("Nibble," "Houseparty," "we," or "us") governing the Houseparty iOS app, our website, invitation pages, and related services (together, the "Service"). By creating an account, tapping acceptance where shown, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains our data practices, and our Community Guidelines form part of the conduct rules in these Terms. The Privacy Policy is a notice, not blanket consent or a waiver of privacy rights.

Eligibility and authority

You must be at least 18 years old and legally capable of entering this agreement. Houseparty is not intended for or available to anyone under 18, anyone prohibited from receiving the Service under applicable law, or anyone whose account we previously terminated for a serious violation unless we authorize a return. If you use the Service for an organization, you represent that you can bind it to these Terms.

You must give truthful age and account information. We may request proportionate information to confirm eligibility, investigate an under-age report, or satisfy legal duties. Providing false age or identity information is a material violation.

Your account and security

  • Keep control of your phone number, Apple sign-in, device, and account. You are responsible for activity you authorize.
  • Never share a one-time verification code. Houseparty support will not ask you for an OTP.
  • Use accurate, non-deceptive profile information and keep it reasonably current.
  • Tell us promptly if you suspect unauthorized access, SIM takeover, or another security issue.
  • Do not sell, rent, transfer, or provide automated access to your account.

Phone verification confirms control of a number at that moment; it does not prove a person's civil identity. We use rate limits, fraud checks, device/app attestation, and other safeguards, but you remain responsible for securing your device and carrier account.

The Service and your license

Houseparty provides profiles, friend connections, contact and username discovery, invitations, groups, live audio/video rooms, screen sharing, status posts, photos, video or voice messages, reactions, notifications, support, reporting, blocking, and related features. Some features depend on device, region, permissions, network conditions, or provider availability.

Subject to these Terms, Nibble grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the object-code version of the app on devices you own or control for non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, extract source code, bypass technical controls, or create derivative works except where law expressly permits and does not allow that restriction.

We may add, modify, test, limit, or retire features to improve the Service, safety, reliability, or legal compliance. We will not intentionally remove a paid entitlement without providing any remedy required by law. Houseparty currently does not sell subscriptions or in-app digital goods; if that changes, price, renewal, cancellation, and refund terms will be shown before purchase.

Permissions, contacts, and invitations

Contacts, camera, microphone, photos, screen share, and notifications are optional device permissions. A feature may not work if its required permission is declined. You can change permissions in iOS Settings.

If you enable contact matching, you authorize Houseparty to read the contacts iOS makes available and submit their normalized phone numbers for the limited real-time matching process described in the Privacy Policy. You represent that you will use matches and invitations only for genuine personal connection—not scraping, profiling, harassment, bulk marketing, or commercial solicitation.

Send an invitation only to someone you know and reasonably believe is willing to receive it. You are responsible for the content and recipients of SMS messages sent through your device, and carrier or data charges may apply. Do not upload purchased lists or use Houseparty to contact people unlawfully.

Your content and the license needed to deliver it

You keep ownership of content you create or submit ("User Content"). You grant Nibble a worldwide, non-exclusive, royalty-free license to host, store, reproduce, encode, adapt for technical delivery, transmit, display, and make User Content available to the people and groups you select, and to use it as reasonably necessary to operate, secure, moderate, troubleshoot, and improve the Service. This license includes the right to use contracted providers for those purposes.

The license ends when the relevant content is deleted from active systems, except to the extent a copy remains with a recipient, in ordinary backup rotation, or is retained for a report, legal duty, dispute, or safety reason. We do not claim ownership of User Content or a right to use private content in advertising.

You represent that you have the rights and permissions needed to submit User Content and that our permitted use will not violate law or another person's copyright, privacy, publicity, confidentiality, or other rights. Do not share another person's private or intimate content without authorization.

Live communications and recipient privacy

Live rooms transmit audio and video to the participants shown in the app. Screen sharing can expose notifications, credentials, photos, messages, and information from other apps; check your screen before starting it. Do not record or redistribute a call unless everyone affected has been informed and all required consents have been obtained. Recording laws vary by location and are your responsibility.

Content can be copied, recorded, or screenshotted by recipients. A notification can reveal limited sender or message context on a locked screen according to the recipient's device settings. Do not send content you are not comfortable sharing with the selected audience.

Acceptable use

You may not use or help others use Houseparty to:

Harm peopleThreaten, stalk, bully, harass, exploit, extort, dox, impersonate, or encourage self-harm or violence.
Exploit minorsCreate, request, possess, distribute, or facilitate child sexual abuse material, grooming, sexualization, or any exploitation of a minor.
Share abusive sexual contentPost non-consensual intimate imagery, sexual violence, unlawful pornography, or sexual content involving anyone under 18.
Promote hate or violenceAttack protected groups, praise violent extremism, organize violent wrongdoing, or make credible threats.
Commit fraud or crimeScam, phish, launder money, traffic prohibited goods, violate sanctions, or coordinate unlawful conduct.
Invade privacy or IPExpose private data, intercept communications, violate confidentiality, or infringe copyright, trademark, publicity, or other rights.
Attack the ServiceProbe security, distribute malware, evade rate limits, overload systems, abuse OTPs, spoof requests, or access data without authorization.
Automate or scrapeUse bots, crawlers, scripts, account farms, bulk invitations, or data extraction without our written authorization.

Context matters, including newsworthiness, education, counterspeech, and documentation of abuse, but those contexts do not permit content that is itself illegal or creates an unreasonable safety risk.

Reports, moderation, recommendations, and appeals

Users can block accounts and report users or content in the app. You may also email team@onlywidget.com. A useful notice identifies the content or account, its exact location or context, why it is illegal or violates these Terms, your contact information, and a good-faith statement that the notice is accurate. Emergency threats should also be reported to local emergency services.

We may investigate, reduce visibility, remove content, disable features, preserve evidence, warn, block invitations, suspend, or terminate accounts when we reasonably believe it is necessary to enforce these Terms, protect users or the Service, respond to a valid notice, or comply with law. We consider context, severity, intent, harm, history, and the risk of recurrence. Automated systems may detect spam, fraud, rate-limit abuse, or technical risk; significant content and account decisions are subject to human review where required.

Where required, we will give the affected user a statement of reasons and an opportunity to appeal. Appeal by replying to the notice or emailing us with "Moderation Appeal", the account identifier, and the reason the decision should change. If the EU Digital Services Act applies, eligible complaints may be submitted for at least six months after notice of the decision and will be handled in a timely, non-discriminatory, non-arbitrary manner with qualified human supervision. Statutory rights to certified out-of-court settlement or court review remain unaffected.

How friend suggestions are ordered

Find Friends uses contacts you permit, whether a number matches an account, mutual-friend count, recent presence, existing request/friend state, and local display ordering. It is not based on ads or sensitive-trait profiling. Disable contact access in iOS Settings to stop contact-based suggestions; username and invite-link discovery remain available.

Houseparty intellectual property and complaints

The Service, software, branding, designs, and non-user content are owned by Nibble or its licensors and protected by intellectual-property law. These Terms grant only the limited license in Section 4. No rights are granted to use Houseparty or Nibble names, logos, or marks without written permission.

To report copyright or other rights infringement, email us with your contact information, identification of the protected work or right, the exact location of the challenged material, a good-faith statement, a statement under penalty of perjury that the information is accurate and you are authorized to act, and a physical or electronic signature. We may forward a compliant notice to the affected user and process a valid counter-notice as required by law. Repeated infringement may result in termination.

Third-party services and open-source software

Houseparty depends on Apple, Google Firebase and Google Cloud, Agora, Prelude, PostHog, Vercel, Slack, OpenAI, telecommunications carriers, and other providers identified in the Privacy Policy. Provider availability and lawful terms can affect a feature. Your use of Apple, your carrier, or another independently controlled service is also governed by that provider's terms.

The app includes open-source components governed by their own licenses. Those licenses apply to the relevant component and may provide rights in addition to these Terms. We are not responsible for third-party websites, user-created links, or services outside our control, but this does not limit any responsibility we cannot exclude by law for providers acting on our behalf.

Suspension, termination, and ending use

You may stop using Houseparty at any time and may delete your account in Settings. We may restrict, suspend, or terminate access for a material or repeated violation, serious safety or security risk, unlawful conduct, non-payment if paid features are introduced, prolonged inability to provide the Service lawfully, or discontinuation of Houseparty. Where appropriate and legally required, we will provide notice, reasons, and an appeal opportunity before or promptly after action. Urgent risk can require immediate action.

On termination, your app license ends. Sections that by their nature should survive—including ownership, limited retained-content licenses, enforcement, disclaimers, liability, dispute terms, and accrued rights—remain effective. Data is handled under the Privacy Policy, not kept merely because these Terms survive.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not promise uninterrupted or error-free operation, permanent availability of any feature or content, or that every user will comply with these Terms. Internet, carrier, platform, and provider failures can affect the Service.

To the fullest extent permitted by law, Nibble and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, goodwill, data, or business opportunity, arising from the Service. Our aggregate liability for claims arising from the Service will not exceed the greater of US $100 or the amount you paid Nibble for the Service during the 12 months before the event giving rise to the claim.

These exclusions do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory data-protection duties, or any warranty, remedy, right, or liability that applicable law does not permit us to exclude or limit. Consumers retain all mandatory rights and remedies in their country or state.

If you use the Service on behalf of a business, that business will defend and indemnify Nibble from third-party claims arising from its unlawful use, User Content, or material breach of these Terms, except to the extent caused by Nibble. This business indemnity does not apply to consumers acting in a personal capacity.

Governing law and disputes

Delaware law governs these Terms, without regard to conflict-of-law rules, except that mandatory consumer and data-protection laws of your habitual residence continue to apply. Before filing a claim, please contact us and describe the issue so both sides can try in good faith to resolve it informally.

Subject to mandatory local rights, state and federal courts located in New Castle County, Delaware have jurisdiction over disputes. If you are a consumer in the EEA, UK, Switzerland, or another jurisdiction that gives you a non-waivable right to bring proceedings in your local courts, nothing here removes that right. Nothing prevents either party from seeking urgent injunctive relief or using a qualifying small-claims procedure.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a merger, reorganization, financing, or sale of the Service, subject to applicable notice rights. These Terms, incorporated policies, and any feature-specific terms are the entire agreement about the Service.

Terms required for Apple-distributed apps

These Terms are between you and Nibble, not Apple. Nibble—not Apple—is solely responsible for the app, its content, maintenance, support, warranties, and claims relating to it, subject to applicable law. Your license is limited to use on Apple-branded products you own or control as permitted by the Apple Media Services Terms, including Family Sharing or volume-purchase rules where applicable.

If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation. Nibble is responsible for addressing product-liability, legal-compliance, consumer-protection, privacy, and intellectual-property claims relating to the app. You represent that you are not located in a U.S.-embargoed country or on a U.S. restricted-party list. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it after your acceptance of these Terms.

Changes, notices, and contact

We may update these Terms to reflect new features, provider or business changes, safety needs, or law. We will post the revised Terms and update the effective date. For material changes, we will provide reasonable advance in-app or other notice and request acceptance where required. Changes do not retroactively reduce accrued consumer rights. If you do not accept revised Terms, stop using and delete your account.
